Acceptable Use Policy

1. Introduction and Purpose

This Acceptable Use Policy ("AUP") is an integral part of your agreement with Weniba ("we," "us," "our") and is incorporated by reference into our Terms of Service. Its purpose is to define the acceptable and prohibited uses of our hosting services, network, and infrastructure (collectively, the "Services"). This policy is designed to protect the integrity, security, and reliability of our network and to ensure a high-quality experience for all our customers. By using our Services, you agree to comply fully with this AUP. Any violation of this AUP may result in the immediate suspension or termination of your Services, as detailed in our Terms of Service.

This policy is not exhaustive, and we reserve the right to modify it at any time. We expect our users to exercise responsible judgment and to act in a manner that is respectful of our resources and the online community. Ignorance of this AUP does not excuse a violation. It is your responsibility to ensure that all activities conducted through your account, whether by you or a third party, comply with this policy.

2. Prohibited Activities and Content

The Services provided by Weniba must be used for lawful purposes only. You are strictly prohibited from using the Services to transmit, store, display, or distribute any information, data, or material that violates any applicable law or regulation, or that is directly or indirectly harmful to others. Prohibited activities include, but are not limited to:

Illegal Use: Using the Services in any way that violates federal, state, local, or international law. This includes storing or distributing copyrighted material without authorization, engaging in fraudulent activities, or transmitting material that is defamatory, obscene, or constitutes an illegal threat.

Intellectual Property Infringement: Hosting, distributing, or linking to any material that infringes on the intellectual property rights of others, including copyrights, trademarks, service marks, trade secrets, and patents.

Harmful or Abusive Content: Hosting content that is threatening, abusive, harassing, defamatory, or that promotes violence, terrorism, or hate speech. This includes content that is libelous or invasive of another's privacy.

Child Pornography: The storage, possession, or distribution of child pornography is strictly forbidden and is a zero-tolerance violation. Any account found to be engaging in such activity will be immediately terminated without notice and reported to the relevant law enforcement authorities.

3. System and Network Security

You are prohibited from violating or attempting to violate the security of the Weniba network and its systems. Any such violations may result in criminal and civil liability. We will investigate all suspected violations and will cooperate fully with law enforcement authorities in prosecuting users who are involved in such violations. Examples of system or network security violations include, but are not limited to:

Unauthorized Access: Accessing data, systems, or accounts not intended for you, or logging into a server or account that you are not expressly authorized to access.

Vulnerability Scanning: Probing, scanning, or testing the vulnerability of any system or network without the express written permission of Weniba.

Breaching Security Measures: Breaching security or authentication measures without proper authorization.

Interference: Interfering with service to any user, host, or network, including, without limitation, by means of "mail-bombing," "flooding," "denial of service attacks," or "crashing."

Forging Headers: Forging any TCP/IP packet header or any part of the header information in an email or a newsgroup posting.

4. Email and Communication Policy

Sending unsolicited bulk email ("spam") from or through our network is strictly prohibited and is subject to a zero-tolerance enforcement policy. Users must comply with all applicable anti-spam and electronic communication laws and regulations, including but not limited to the CAN-SPAM Act, GDPR, and other applicable international laws. Any violation of this policy will result in immediate suspension or termination of the offending service or account without prior notice.

Prohibited activities include, but are not limited to:

  • Sending unsolicited emails to individuals or organizations who have not explicitly opted in to receive such communications.

  • Sending bulk email, marketing email, or mass mailing without verifiable and provable opt-in consent records.

  • Using purchased, rented, scraped, or third-party email lists.

  • Using our network to receive replies to unsolicited emails sent from another network (backscatter or indirect spam).

  • Operating open SMTP relays, open proxies, or misconfigured mail servers.

  • Sending phishing emails or operating fraudulent pages designed to collect sensitive information.

  • Email bombing, mail flooding, or mass messaging intended to disrupt or harass.

  • Sending harassing, abusive, defamatory, or threatening communications.

  • Using misleading headers, forged sender information, or deceptive subject lines.

  • Creating multiple accounts or services for the purpose of sending spam or bypassing sending limits.

Weniba maintains a strict zero-tolerance policy regarding spam and email abuse. Any account, service, or server suspected of being involved in spam, phishing, or email abuse may be immediately suspended or terminated without notice. Weniba reserves the sole and absolute right to determine what constitutes spam or email abuse.

Users must maintain verifiable records of email recipient consent (including opt-in date, IP address, and signup source) and must provide such records upon request. Failure to provide proof of consent will be considered a violation of this policy.

Weniba may charge administrative or cleanup fees for blacklist removal, abuse handling, or network damage caused by spam or email abuse. Weniba reserves the right to report such activity to relevant authorities, regulatory organizations, blacklist databases, and law enforcement agencies.

No refunds will be issued for accounts terminated or suspended due to violations of this Email and Anti-Spam Policy. Weniba shall not be liable for any damages, data loss, business loss, or reputational damage resulting from suspension or termination due to spam or email abuse.

5. Data Backup and Responsibility for Data Loss

You, the customer, are solely and exclusively responsible for the preservation and backup of your own data, including all User Content, websites, databases, emails, and any other information stored on our Services ("Your Data"). While Weniba may, as a courtesy, perform its own system backups for disaster recovery purposes, these backups are not intended to replace your own backup procedures and are not guaranteed to be available or complete.

Weniba does not guarantee the availability or integrity of any backups. We strongly recommend that you maintain your own regular, independent backup copies of Your Data in a secure, off-site location. In the event of data loss, hardware failure, or any other event, Weniba shall not be liable or responsible for any loss of Your Data whatsoever, regardless of the cause. You agree to hold Weniba harmless from any and all claims related to the loss of data. It is your responsibility to implement a robust backup strategy to protect your critical information.

6. Enforcement and Violations

Weniba reserves the right to investigate any suspected violation of this AUP. We may attempt to contact you to notify you of the activity and request that you take corrective action. However, we reserve the right, in our sole discretion, to suspend or terminate your access to the Services immediately, without prior notice, if the violation is severe, willful, or repeated. No refunds or credits will be issued for service interruptions resulting from a violation of this AUP.

We may also cooperate with legal authorities and/or third parties in the investigation of any suspected or alleged crime or civil wrong. Your violation of this AUP may subject you to criminal or civil liability. Our failure to enforce this policy in every instance does not amount to a waiver of our rights.

7. Resource Usage and Fair Use Policy

All hosting services provided by Weniba are shared environments unless otherwise specified. Users may not use excessive system resources that negatively impact other users or the stability of the server. This includes excessive CPU usage, RAM usage, disk I/O, entry processes, inodes, or network usage.

Services advertised as "unmetered" are subject to fair and reasonable usage. Unmetered services are intended for normal website hosting purposes only and may not be used for file storage, backup storage, media distribution, or any use that is not directly related to the operation of a website.

The following activities are strictly prohibited on shared hosting services:

  • File storage or backup storage not related to an active website.

  • Public file hosting or image hosting services.

  • Video streaming services.

  • Large download or file distribution services.

  • Running resource-intensive scripts that degrade server performance.

  • Cryptocurrency mining.

  • Running bots, crawlers, or automated scripts that consume excessive resources.

  • Excessive email sending that impacts server performance.

Weniba reserves the right to suspend, throttle, limit, or terminate any account that excessively uses server resources or affects server stability, with or without prior notice. Accounts found to be using excessive CPU resources for a sustained period of time, or causing performance degradation to the server, will be considered in violation of this policy. Weniba’s decision regarding what constitutes excessive usage or resource abuse shall be final and binding. No refunds will be provided for suspensions or terminations related to resource abuse or violation of this Fair Use Policy.
